September 2010

The KwaZulu Natal Chapter hosted their annual "Ladies Breakfast" on 20 August 2010, which, following a decision to allow male delegates immediately became known as the Women's month breakfast.  The Honourable Madam Justice Leone Theron presented a 'down-to-earth' speech entitled "Engendering a balance".  There were 43 attendees on the day.

Membership of the chapter is currently at 107 members.

The Chapter's round-table seminar, held on Thursday, 22 April 2010, which is normally limited to 20 seats, attracted 34 delegates.  Adv Andreas Coutsoudis of the Durban Bar led discussions by setting the basic framework and giving attendees insight into the recent SCA decision by WALLIS AJA in SAMSA c McKenzie (017/09) [2010] ZASCA 2 (15 February 2010) and by HARMS DP, VAN HEERDEN, CACHALIA, SHONGWE JJA et THERON AJA in De Lange v Absa Makelaars (262/09) [2010] ZASCA 21 (23 March 2010).  Thereafter, the issues were debated at length. It was good to see senior attorneys present at the round-table function. Also in attendance was Tammy Cohen of UKZN, referred to by Wallis AJA, in the Judgment.

The AGM took place on Thursday, 13 May 2010.  The usual requirements of a Chapter AGM were dealt with, including the President's Annual Report.  Following the AGM itself, Mr Richard Haslop of Woodhead Bigby & Irving addressed delegates on "Labour Brokers: The law in the midst of all the politics".  The idea initially was to discuss legislative developments relating to TES.  However, in the absence of such legislative developments actually eventuating, Richard discussed a number of cases relating to the "flexibility" of TES employees.  His paper focused on the so-called fixed term nature of TES employees' contracts of employment and the so-called automatic termination clauses also commonly found in TES employees' contracts of employment.  There were approximately 30 attendees.

The Chapter has secured Professor Alan Rycroft (UCT) and Benita Whitcher (Consultant to Brett Purdon attorneys and UKZN) to engage in a debate on Rycroft's "Corporate Bullying" and Whitcher's "Corporate Robustness" on the 22 July 2010.

Earlier, on 29 July 2010, the KZN Chapter committee secured Professor Alan Rycroft (UCT) and Benita Whitcher (UKZN and Consultant to Brett Purdon attorneys and UKZN) to engage in a debate on Rycroft's "Corporate Bullying" and Whitcher's "Corporate Robustness".  This seminar was an example of "thought leadership" as none of the ideas expressed were necessarily mainstream, but, never-the-less provided insight into where Labour law may venture.

The KZN Committee also arranged for interested parties to participate in a workshop on "Improving the Labour Court Rules to address systemic failures" - as a prelude to National Conference Workshop held at Deneys Reitz Inc on 15 September 2010.

KZN membership stands at 102.
